Terms and Conditions (General Conditions of Sale - GCS)

1. General Information

These Terms and Conditions ("GCS") govern all sales made by YNOT via its online platform. By placing an order, you agree to these GCS. These terms are adapted to meet the legal requirements of the regions we serve, including the European Union (EU), the United States (US), and Canada.

2. Products

YNOT specializes in custom, made-to-order apparel. Each item is manufactured based on customer specifications, such as size, color, and design. As such, these products are considered personalized under applicable consumer protection laws.

3. Pricing

All prices displayed on the website are in euros (€) and include applicable taxes. Shipping costs are calculated and displayed at checkout.

4. Order Process

Orders are confirmed only after payment has been successfully processed. A confirmation email, including details of the order, will be sent to the customer.

5. Right of Withdrawal and Refunds

5.1 Products Made to Order

In accordance with Article L221-28 of the French Consumer Code and equivalent provisions under the EU Consumer Rights Directive (2011/83/EU), made-to-order or personalized products are not eligible for returns or refunds, except in cases of defect or non-conformity.

Similarly, under US and Canadian consumer laws, returns for personalized goods are generally not required unless the product is defective or does not meet its description.

5.2 Defective or Non-Conforming Products

If the product is defective or does not conform to the order:

Customers must notify YNOT within 14 days of receiving the item.

YNOT will either replace the defective product or issue a full refund, including shipping costs, where applicable.

5.3 Exceptions to Non-Refundable Policy

Standard (non-personalized) items, if offered, may be eligible for return within the applicable withdrawal period. Refer to the specific terms provided at the time of purchase.

6. Shipping and Delivery

YNOT ships internationally. Delivery times vary by region. The customer is responsible for any customs duties or taxes imposed by the destination country.

7. Consumer Protection in Specific Regions

European Union (EU)

YNOT complies with the EU Consumer Rights Directive, including the obligation to provide detailed pre-contractual information and respect guarantees of conformity under Directive 1999/44/EC.

United States (US)

Returns and refunds for US-based customers are governed by federal and state laws. Custom products are non-refundable under applicable laws, unless defective.

Canada

Canadian customers are protected under provincial consumer laws. For example, under the Quebec Consumer Protection Act, personalized goods are non-returnable unless defective or non-conforming.

8. Intellectual Property

All designs, logos, and products sold by YNOT are protected under intellectual property laws. Any reproduction or unauthorized use is prohibited.

9. Governing Law

These GCS are governed by the laws of France. For international sales, mandatory consumer protection laws in the customer’s country of residence will also apply.
